DaysWith — Privacy

DaysWith is a journaling app that uses AI to generate personalized responses, insights, and artifacts based on your diary entries. This policy explains what data we collect, how we use it, and your rights.

What we collect

Account information: Name, email address, and authentication data
Diary content: Your entries, sparks, pulses, reflections, goals, and any text you write. This may include sensitive personal information such as health, emotional, or relationship details you choose to share.
Timezone: Your device timezone for scheduling morning messages and determining day boundaries
Usage data: App interactions such as days active, entry counts, and feature usage to provide personalized features and enforce limits
Subscription status: If you purchase Plus, we receive subscription status from Apple

AI Processing

DaysWith uses third-party AI services to generate personalized content including:

Morning messages tailored to your life
Responses to your diary entries
Patterns and insights from your history
Artifacts (visual memories) for Plus subscribers
Safety classification (see below)

Current providers: We currently use Google Gemini and Mistral AI. Your diary content is sent to these providers for processing according to their respective terms: Google Cloud Privacy Notice, Gemini API Terms, and Mistral AI Terms.

Provider changes: We may change AI providers (to services such as OpenAI or others) at any time. When we do, we will update this section and, if the change is material, notify you through the app. Each provider has their own data processing and retention policies.

By using DaysWith, you acknowledge and consent to your diary content being processed by our AI provider(s) to provide the core features of the app.

Content safety & automated analysis

Every diary entry is automatically analyzed by AI to detect safety concerns. This system classifies entries to identify:

Signs of emotional distress or crisis that may warrant support resources
Policy violations such as illegal content or credible threats

What happens when content is flagged:

An internal alert is created for our team to review
You may see crisis helpline information in the app
In serious cases, your account may be restricted pending review

Human review: We do not read your entries unless they are flagged by the automated system. Flagged entries may be reviewed by our team to determine appropriate action.

This analysis is intended for your wellbeing and platform safety. DaysWith is not a substitute for professional mental health care.

How we use your data

App Functionality:

To save, sync, and display your diary history across devices
To manage your account and authentication
To deliver morning messages at the right time using your timezone
To enforce usage limits based on your subscription tier
To perform content safety analysis

Product Personalization:

To generate AI responses that reference your history and context
To create personalized morning messages
To identify patterns and moments from your entries
To build your constellation view of people, topics, and goals
To unlock features based on your usage (e.g., patterns after 30 days)

Data storage & encryption

Your diary data is stored on our servers to enable sync across devices and AI-powered features.

Encrypted at rest

The following data is encrypted on our servers using AES-256-GCM:

Diary entries and summaries
AI responses to your entries
Patterns, moments, and insights
Goals and morning messages
Sparks and pulses content
People and topics extracted from your entries

Not encrypted

Account information (email, name)
Timestamps and usage counts
Subscription status

AI processing

When your content is sent to AI providers for processing, it is decrypted and transmitted to the provider. See the AI Processing section above for details on which providers we use.

Your controls

Export: Download your complete diary data anytime from Settings
Delete: Permanently delete your account and all data from Settings
Notifications: Control morning message timing and alerts

When you delete your account, we remove your data from our systems. Note that data already sent to our AI provider(s) is subject to their respective data retention policies.

International users

DaysWith is operated from Austria. Your data may be processed in locations where our servers and AI providers operate, which may include the United States and European Union.

EU/EEA users: We process your data based on your consent (given when you accept these terms) and our legitimate interest in providing the service. You have the right to access, correct, delete, and port your data, and to withdraw consent at any time by deleting your account.

California residents: Under the CCPA, you have the right to know what personal information we collect, request deletion, and opt out of the sale of personal information. We do not sell your personal information.

What we do NOT do

We do not share your data with data brokers
We do not track you across other apps or websites
We do not use third-party analytics services

Third-party services

AI providers: Currently Google Gemini and Mistral AI; may include OpenAI or others (see AI Processing section above)
Apple: App distribution, Sign in with Apple, in-app purchases, and push notifications

Changes to this policy

We may update this policy as our service evolves. Significant changes will be communicated through the app or email. Continued use of DaysWith after changes constitutes acceptance of the updated policy.
